1. Purpose and Scope
These General Terms and Conditions of Sale (T&C) govern the contractual relationship between JOIE DE VIVRE (YOUNG & ECO) and any natural or legal person (hereinafter "the Customer") using the website www.young-eco.com or purchasing a product.
They comply with:
- The French Consumer Code
- The French Civil Code
- The French Commercial Code
- Directive 2011/83/EU on consumer rights
- Ordinance No. 2026-2 of January 5, 2026 (online withdrawal functionality)

3. Website Access
Access to the website www.young-eco.com is free, excluding connection costs borne by the user.
Young & Eco strives to ensure continuous access to the website but cannot guarantee permanent availability. Interruptions may occur for:
- Technical maintenance
- Security updates
- Circumstances beyond our control
In case of scheduled interruption, users will be informed whenever possible.
4. Products and Cosmetic Compliance
The products offered are clean beauty cosmetic skincare formulated according to COSMOS ORGANIC and COSMOS NATURAL standards, certified by Ecocert when mentioned.
4.1 Regulatory Compliance
Each formula complies with Regulation (EC) No. 1223/2009 on cosmetic products and includes:
- Safety assessment conducted by a qualified assessor
- Product Information File (PIF) maintained and available to competent authorities
- CPNP notification (Cosmetic Products Notification Portal) when required by European regulations
4.2 Product Information
Product descriptions, ingredient lists (INCI), usage instructions and precautions are provided for each product on the website and on packaging, in accordance with Article 19 of Regulation (EC) No. 1223/2009.
Important: Cosmetic products are intended for external use only and must be used according to the instructions provided.
4.3 Photographs and Visuals
Product photographs are as accurate as possible. However, color variations may appear depending on screens. Young & Eco cannot be held responsible for these display differences.
5. Traceability, Suppliers and Packaging
Young & Eco works with certified European suppliers and subcontractors (environmental and manufacturing standards such as ISO 14001, Good Manufacturing Practices), specialized in responsible production of glass, aluminum, cardboard and bio-based material packaging.
5.1 Sustainable Materials
Each material is, at minimum:
- Traceable (documented origin and manufacturing)
- Recyclable or from renewable resources
- Manufactured according to environmental standards
Features:
- Plant-based or low-impact inks
- Compostable cushioning
- Non-recyclable plastic use limited to strict minimum
5.2 Extended Producer Responsibility (EPR)
In accordance with the AGEC Law (Law No. 2020-105 of February 10, 2020 on the fight against waste and circular economy), Young & Eco:
- Contributes to approved recycling channels
- Adheres to an eco-organization for packaging waste management
- Develops a voluntary take-back program for empty bottles
Eco-contribution: Included in product prices (financing packaging recycling)
6. Order and Validation
6.1 Prior Acceptance of T&C
Before validating any order, the Customer acknowledges having read and accepted these General Terms and Conditions by means of a mandatory checkbox on the payment page.
In accordance with French Court of Cassation case law, online sale is validly concluded provided that the T&C are expressly accepted by the consumer.
6.2 Pre-contractual Information
In accordance with Article L221-5 of the French Consumer Code, the Customer is informed of all the following elements before final validation of their order:
- Essential product characteristics
- Total price including tax (product + delivery costs + eco-contribution)
- Detailed delivery costs by zone
- Estimated delivery times
- Accepted payment methods
- Existence and terms of the right of withdrawal
- Any return costs borne by the Customer
- Applicable legal warranties
- Offer validity period
6.3 Contract Archiving
An electronic copy of the sales contract and invoice is archived in Shopify's secure systems, in accordance with Article 1127-1 of the French Civil Code.

Archiving period: 10 years (accounting obligation)
6.4 Order Confirmation
Any validated order implies unreserved acceptance of these General Terms and Conditions of Sale.
The order becomes firm and final upon receipt of:
- Full payment
- Order confirmation email
6.5 Right to Refuse an Order
Young & Eco reserves the right to refuse or cancel an order in case of:
- Proven fraud or suspected fraud
- Order anomaly (incorrect price, technical bug)
- Non-payment or payment incident
- Incomplete or incorrect information
- Manifestly abusive order
The Customer will be informed by email and any payment made will be fully refunded within 14 days.
7. Prices and Secure Payment
7.1 Pricing
Prices are indicated in euros, all taxes included (incl. VAT), including:
- Product price
- Applicable VAT (rate in effect)
- Eco-contribution (packaging recycling financing)
Not included in product price:
- Delivery costs (displayed before validation)
- Customs duties and import taxes (international deliveries)
7.2 Price Modifications
Young & Eco reserves the right to modify its prices at any time.
Guarantee: Products will be invoiced at the price in effect at the time of order validation, subject to availability.
7.3 Accepted Payment Methods
Payments are made via secure solutions:
- Credit/debit card (Visa, Mastercard, American Express)
- Shopify Payments
- Stripe
- PayPal
- Apple Pay, Google Pay (depending on availability)
7.4 Payment Security
SSL/TLS Protection: All transactions are protected by SSL encryption (256-bit certificate).
Confidentiality: Young & Eco never has access to bank details. Payment processing is handled exclusively by PCI-DSS certified providers (Payment Card Industry Data Security Standard).
Tokenization: Bank details are replaced by a unique token and never stored in clear text.
7.5 Deferred or Installment Payment
Young & Eco may offer installment payment solutions via financial partners. Specific conditions will be communicated before validation.
8. Delivery and Shipping
8.1 Order Preparation
Orders are prepared and shipped from our international logistics network.
Preparation time: 1 to 3 business days (excluding weekends and public holidays)
8.2 Delivery Times
Times are indicated as estimates and vary by destination:

Important: These times are estimates and may vary depending on carrier, customs clearance (international) or unforeseen circumstances.
8.3 Delivery Methods
- Standard delivery: Normal times
- Express delivery: Accelerated times (subject to availability and destination)
- Collection point: Available in France and some EU countries
8.4 Transfer of Risk
In accordance with Article L216-4 of the French Consumer Code, the risk of loss or damage to products is transferred to the Customer upon receipt of the parcel.
In case of parcel damaged during transport:
- Refuse the parcel or make written reservations on the delivery note
- Contact us immediately with photos: support@young-eco.com
- Deadline: 48 hours after receipt
8.5 International Deliveries (outside EU)
For deliveries outside the European Union, products comply with applicable regulations when necessary.
Important: It is the Customer's responsibility to verify local compliance before importation (customs restrictions, specific cosmetic regulations).
Customs duties and taxes: At the Customer's expense (see section 12)
9. Right of Withdrawal (14 days)
9.1 Legal Period
In accordance with Article L221-18 of the French Consumer Code, the Customer has a period of 14 days from receipt of the product to exercise their right of withdrawal without having to justify their decision.
9.2 How to Exercise Your Right of Withdrawal
🆕 NEW — Mandatory from June 19, 2026
In accordance with Ordinance No. 2026-2 of January 5, 2026 and the implementing decree of January 5, 2026, the professional must provide a specific online device allowing the consumer to exercise their right of withdrawal directly on the website.

9.3 Products Excluded from the Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does NOT apply to:
❌ Unsealed products after delivery that cannot be returned for hygiene or health protection reasons (opened cosmetics)
❌ Personalized products or made to Customer specifications
❌ Perishable products or products likely to deteriorate rapidly
❌ Sealed products whose seal has been broken after delivery
In short: Opened, used or unsealed cosmetic products cannot be returned for hygiene and health safety reasons.
9.4 Return Period
The Customer has 14 days from notification of their decision to withdraw to return the product.
10. Returns, Refunds and Legal Warranties
10.1 Return Procedure
Deadline: Return requests must be sent to support@young-eco.com within 14 days from receipt.
Return conditions:
✅ Products unopened and unused
✅ Original packaging intact (seal unbroken)
✅ Labels present
✅ Proof of purchase included (invoice or confirmation email)
Return address: Communicated by email after validation of your withdrawal request.
⚠️ NEVER return a product without contacting our customer service first.
10.2 Return Costs
In accordance with Article L221-23 of the French Consumer Code, return costs are borne by the Customer in case of withdrawal, unless Young & Eco failed to inform them (in which case Young & Eco covers the costs).
Exception: In case of error attributable to Young & Eco (defective product, delivery error), return costs are covered by Young & Eco (prepaid return label provided).
10.3 Refund
In accordance with Article L221-24 of the French Consumer Code:
Period: Refund made within a maximum period of 14 days from the date we are informed of your decision to withdraw.
Possibility to defer: Young & Eco may defer the refund until receipt and verification of the returned product.
Method: Refund made by the same payment method used for purchase, unless express agreement from the Customer for another method without additional charges.
Amount refunded:
- Withdrawal (14 days): Product price + initial standard delivery costs
- Defective product/Young & Eco error: Product price + initial delivery costs + return costs
Express delivery costs: Not refunded (except error attributable to Young & Eco)
10.4 Legal Warranty of Conformity (2 years)
In accordance with Articles L217-3 to L217-20 of the French Consumer Code, all products benefit from a legal warranty of conformity of 2 years from receipt.
In case of non-conformity, the Customer may obtain, free of charge:
- Repair of the product
- Replacement of the product
- Price reduction (if repair/replacement impossible or disproportionate)
- Contract termination (full refund)
According to the terms provided in Articles L217-8 and L217-10 of the French Consumer Code.
Presumption of non-conformity: Any defect appearing within 24 months from receipt is presumed to exist at the time of delivery (Article L217-7).
10.5 Warranty Against Hidden Defects (2 years)
In accordance with Articles 1641 and following of the French Civil Code, the warranty against hidden defects applies.
In case of a hidden defect making the product unfit for its intended use, the Customer may:
- Request full refund (redhibitory action)
- Request a price reduction (estimatory action)
Period: 2 years from discovery of the defect
10.6 Liability for Defective Products
The Customer also benefits, in accordance with the Law of May 19, 1998, from liability for defective products.

11. Ethical Charter and Cruelty-Free
Young & Eco guarantees that no product or ingredient is tested on animals, in accordance with Regulation (EC) No. 1223/2009 (Article 18).

12. International Deliveries — Taxes and Import Duties
12.1 Deliveries Outside the European Union
For orders delivered outside the EU (Switzerland, United Kingdom, Canada, United States, etc.):
French VAT: Automatically deducted for deliveries outside the EU
Customs duties: At the Customer's expense
Local taxes: At the Customer's expense
Customs clearance fees: At the Customer's expense
12.2 Non-Refundable
Customs duties, import taxes and customs clearance fees paid by the Customer are not refundable by Young & Eco, even in case of withdrawal or return.
Advice: Check the applicable fees in your country before ordering.
13. Liability and Force Majeure
13.1 Limitation of Liability
Young & Eco cannot be held responsible for:
- Indirect damages (loss of profit, business interruption, data loss)
- Damage resulting from improper use of products
- Damage resulting from non-compliance with usage instructions
- Allergic reactions (Customer must check INCI list before use)
- Inability to access the website or temporary interruptions
Advice: In case of sensitive skin or known allergy, check the ingredient list (INCI) before purchase.
13.2 Force Majeure
Young & Eco's liability cannot be engaged in case of force majeure as defined by French case law (Court of Cassation), including:
- Natural disaster
- Fire, flood
- Total or partial strike (carriers, suppliers)
- Interruption of telecommunications networks
- Cyberattack, computer virus
- Supplier or subcontractor failure
- Government restrictions (health, customs)
In case of force majeure: Young & Eco will inform the Customer as soon as possible and may suspend or cancel the order with full refund.
14. Applicable Law and Dispute Resolution
14.1 Applicable Law
These General Terms and Conditions of Sale are governed by French law.
For customers outside the EU: French law applies subject to mandatory local rules for consumer protection.
14.2 Amicable Settlement
Any dispute will first be subject to amicable settlement.

In accordance with Article L612-1 of the French Consumer Code and Directive 2013/11/EU, in case of unresolved dispute with a consumer, JOIE DE VIVRE offers free recourse to consumer mediation:

For consumers: Court of the consumer's place of residence or of the registered office of JOIE DE VIVRE, at the consumer's choice (Article R631-3 of the French Consumer Code)
For professionals: Commercial Court of Nanterre
15. Personal Data
The collection and processing of personal data are governed by our Privacy Policy, accessible at: https://young-eco.com/policies/privacy-policy
In accordance with the GDPR and the French Data Protection Act, you have the right to access, rectify, erase, limit, object to and port your personal data.

16. Intellectual Property
All website content (texts, images, logos, videos, design, source code) is the exclusive property of JOIE DE VIVRE (YOUNG & ECO) and is protected by the French Intellectual Property Code and international conventions.
Any reproduction, representation or exploitation is strictly prohibited without prior written authorization.
17. Severability
If one or more provisions of these T&C are declared null or unenforceable, the other provisions will retain their full force and scope, unless the annulled clause is essential and decisive.
18. Modification of T&C
Young & Eco reserves the right to modify these General Terms and Conditions of Sale at any time.
Applicable version: The T&C applicable are those in effect at the time of order validation.
Notification: Substantial modifications will be notified to registered customers by email.
19. Language
These General Terms and Conditions of Sale are written in French and English.
In case of discrepancy in interpretation, the French version shall prevail.
